1. Buyer Beware: You understand that GreenSaver Classifieds is not responsible for the goods or services listed at this website. The Buyers assume all risk, liability, and responsibility for the merchandise purchased through GreenSaverNH.com. GreenSaver Classifieds does not get involved in the transactions between Sellers and Buyers. As a result, we have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the ads. We do our best to control the information provided by users at our web site. Please use caution, common sense, and practice safe trading when using our web site. In addition, by using this web site, you represent that you are aware that there are risks of dealing with underage people or others acting under false pretense. GreenSaver Classifieds is not responsible for item conditions. GreenSaver Classifieds is not responsible for misrepresentation or for the contents of any item for sale on our web site.
  1. Identity Verification: You understand that we have no established feedback system to help you evaluate with whom you are dealing. You may use the "Contact Us" page on GreenSaver Classifieds to report suspicious activity at any time. We also encourage you to communicate directly with potential trading partners through the contact information supplied in the ad. If someone’s ID does not check out, the ad will not be listed and possible suspension (temporarily or indefinitely) from the web site is possible.
2. Release: Because we are only a middle-man, in the event that you have a dispute with a Seller, you release GreenSaver Classifieds (and our officers and employees) from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. You also release GreenSaver Classifieds from any and all liability for any viruses obtained from our server.

3. You understand that GreenSaver Classifieds does not guarantee uninterrupted or secure access to its website. Operation of our website may be interfered with by numerous factors outside of our control.

4. You agree that GreenSaver Classifieds is not responsible for damages or loss caused by errors in the system or the Internet.

  1. GreenSaver Classifieds cannot guarantee that we will notice or prevent anyone from inappropriate use, abuse of our system, or supplying false information. The use of private user information, other than as expressly permitted by this Browser, Buyers Agreement is strictly prohibited. You may contact GreenSaver Classifieds anytime to report questionable activity any time.
  2. To report a policy violation:
    • Include the appropriate information, including related e-mails.
    • GreenSaver Classifieds will consider the circumstances of an offense and the user's record before taking action.
    • Disciplinary action may result in a formal warning or suspension (temporary or indefinite).
    • If a violation cannot be proven with certainty, we may take no action.
    • Due to privacy issues, GreenSaver Classifieds can not discuss the results of a case.
(Listings that violate GreenSaver Classifieds’ policies may result in disciplinary action. This action may include a formal warning, the ending of all violating listings, or even temporary or indefinite suspension of a user’s listing of ads. GreenSaver Classifieds will consider the circumstances of an offense and the user’s trading records before taking action.)

6. You understand that this site is protected under the copyright laws and that GreenSaver Classifieds, LLC. reserves all rights there under. You agree that you will not use any content from our website without the prior express written permission of GreenSaver Classifieds.

7. Access and Interference: You agree that you will not use any monitor or copy our web pages or the content contained herein without our prior expressed written permission. You agree not to copy ads to your website or use them for price comparisons. You agree that you will not use any attempt to interfere with the proper working of the GreenSaver Classifieds web site. You agree that you will not take any action that imposes an unreasonable large load on our system. Much of the information on our website is updated on a real time basis and is proprietary or is licensed to GreenSaver Classifieds by our users.

8. Arbitration: You agree that any legal controversy or legal claim arising out of or relating in any way to this Browser, Buyers Agreement or our services, excluding legal action taken by GreenSaver Classifieds to obtain an injunction relating to, the GreenSaver Classifieds web site operations or to protect our intellectual property, shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Laconia, NH and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Should either party file an action contrary to this provision, the other party may recover attorney’s fees and costs. Either you or GreenSaver Classifieds may seek any interim or preliminary relief from a court of competent jurisdiction in Laconia, NH necessary to protect the rights or property of you or GreenSaver Classifieds pending the completion of arbitration. Should either party file an action contrary to this provision, the other party may recover attorney’s fees and costs up to $1000.00.

9. Liability Limit: You agree that, in no event shall we, our employees or our suppliers be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site, our services or this agreement (however arising, including negligence). You further agree that our liability, the liability of our employees, and to you in any circumstance is limited to the greater of the amount of fees you pay to us in the 12 months prior to the action giving rise to liability, and $100.00. Some states do not allow the exclusion or limitation of incidental or consequential damages, and, therefore, this provision is hereby waived in the event that you reside in such a state.

General: You agree that this Browser, Buyers Agreement shall be governed in all respects by the laws of the State of NH as such laws are applied to agreements entered into and to be performed entirely within NH between NH residents. The laws of the State of NH, excluding its conflicts-of-law rules, govern the Terms and Conditions of this Browser, Buyers Agreement. As noted elsewhere, your conduct may be subject to other local, and state laws. You expressly agree that exclusive jurisdiction for any claim or dispute that is excluded from the above arbitration provision resides in the courts located within the State of NH. You further agree and expressly consent to the exercise of personal jurisdiction in the State of NH in connection with any dispute or claim involving GreenSaverNH.com and/or GreenSaver Classifieds. The Terms and Conditions of this Browser, Buyers Agreement may be amended from time to time, by GreenSaver Classifieds in its sole discretion. If any provision of this agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
